Life Settlements.What is a Life Settlement?  A Life Settlement is the sale of an existing life insurance policy for a lump sum of cash that is more than the cash surrender value.  A life insurance policy is property, like a car, house, stocks and bonds that can be legally sold in accordance with applicable laws.  Through a Life Settlement, a policy owner can realize value today from an asset that is generally thought to only have a benefit when the insured passes away.How can Life Settlements be used in Fundraising?  There are many variations and complex estate and tax planning strategies that can be employed when utilizing Life Settlements in a planned giving program.  However, in its simplest terms, a Donor who owns a life insurance policy gives the policy to the philanthropic organization that in turn immediately sells the policy for a lump sum of cash through a Life Settlement.   In order for a policy to be eligible for a life settlement, it must meet the following criteria:<ul>	<li>Insuring an individual over age sixty-five (65) or with a serious illness	<li>With a face value of at least $100,000	<li>Issued over two (2) years ago</ul>Donor Benefits:<ol>	<li>Making a donation to his/her favorite philanthropic organization without depleting cash reserves or losing income-producing assets;	<li>Getting a tax deduction for the fair market value (selling price) of the life insurance policy instead of only the cash surrender value;	<li>Being able to see their donation put to use during their lifetime rather than after their death if the organization did not utilize a Life Settlement;	<li>Eliminating the requirement of continued premium payments on the policy;	<li>Removing a taxable asset from their estate if the policy was individually held. </P><P></ol>Organization Benefits:<ol>	<li>Receive a donation from a Donor who may not have otherwise been in a position to contribute at all;	<li>Collect a lump sum of cash today instead of having to wait for the insured's death to collect the proceeds;	<li>Not having the financial burden of paying premium payments to keep the policy in force;	<li>Providing a valuable option to the Donor that furthers their tax and estate planning objectives and invites the opportunity for future/additional gifts.	<li>Improved annual budget forecasting ability </ol>How Does a Life Settlement Work?  Once the Donor is considering gifting a life insurance policy to the organization, the life insurance policy should be appraised.  Typically, a Life Settlement Broker can determine its eligibility for a life settlement and will undertake it to obtain the highest offer for the policy.  The value of a life insurance policy is determined by a number of factors, including, but not limited to, the age and medical condition of the insured, type of insurance policy, rating of the issuing insurance company and amount of premium payments to keep the life insurance policy in force.  Most types of insurance policies can qualify, including universal, whole life, and converted term.  When a mutually agreed upon price is determined for the life insurance policy, the organization that now owns the policy is paid a lump sum in cash, the ownership and beneficiary rights are transferred to the purchaser. </P><P> All future premium payments are the responsibility of the purchaser and upon the death of the insured, the death benefit is payable to the purchaser.  The cash proceeds from the Life Settlement may be used by the organization in any way ? there are no restrictions regarding the use of the funds.  The money may be invested or spent on current projects.  Because some Life Settlement Brokers offer fundraising support, it makes sense for organizations to partner with them for their expertise.Life Settlement RegulationsAs of June, 2003, eighteen (18) states have enacted statutes addressing the sale of life insurance policies insuring non-terminally or chronically ill individuals and an additional seventeen (17) states have laws that only regulate the sale of life insurance policies insuring terminally or chronically ill individuals.  Fifteen (15) states do not regulate the transaction at all. </P><P> Donated Life Insurance Policies	In addition, most philanthropic organizations currently own life insurance policies that have been donated in the past. An independent team of cash flow professionals is in the process of developing a code of ethics for participants in the cash flow industry, Fred Rewey, president of the American Cash Flow Association?, announced today."Although our state and regional chapters have a code of ethics that governs relationships between cash flow consultants and their clients, we've felt a need to expand that code to include all elements of the cash flow industry and the relationships that exist," said Rewey."We hope the code of ethics will alert consultants and clients to some of the problems that can arise when they encounter scam artists posing as sources of funding, but we also want respectable funding sources to recognize those consultants who have the clients' best interests at heart," he added. "Serving the legitimate needs of our clients is the primary motivator of all cash flow professionals."The need for an ethics code covering all elements of the cash flow industry became apparent in recent years as more and more consultants reported working with a number of funding sources whom they soon discovered could not be trusted.  Clients also complained of consultants who were promoting funding programs that promised much but provided little."We have always felt that a self-governed industry is far better for all parties than a government regulated industry, and we have seen what happens when scam artists infiltrate the industry, drawing the justified attention of legislators and law enforcement agencies," said American Cash Flow Association's president Rewey.The team of independent consultants and funding sources developing the code of ethics are Dr. Hikmat Abed of Mach I Funding, Roberta Standen of North American Loan Servicing, and Jeff Callender of Dash Point Financial. Managing cash flow is every manager's challenge, every day, every year.  Those managers who keep a close eye on their daily activity and emerging industry trends can help reduce their company's exposure to the chill of a cash crunch.<br />
<br />
How can you predict, avoid and/or, minimize the impact of a cash emergency?<br />
<br />
First, pay attention when any cash shortages arise.  When cash gets short, pay close attention and be prepared to act.  Questions to be answered include:<br />
<br />
1.  What caused the problem?  Pre-payments to take advantage of special discounts can reduce cash. </P><P> Transportation strikes, for example, could delay shipments and therefore payments.  An industry (or economy) slowdown will often result in customers stretching out their payables.<br />
<br />
2.  How can you cope?   If cash on hand is not robust, let the special discounts go.  It's usually more cost-effective to pass on a discount than to borrow to overcome a shortfall.   Keep up on the news. </P><P>If you hear about any threatened strikes and/or disruptions to your supply chain, make sure you have a back-up position.  Even if temporarily more expensive, it can save your business by showing your customers your reliability and versatility in challenging times. If your customers are in industries facing hard economic times, keep closer tabs on your credit policies and be active in collections.  If necessary, tighten credit terms, but use discretion.  Being firm but supportive to your customers will go a long way in keeping them in the fold while still giving you a better cash flow. </P><P> Defer purchases and/or negotiate extended payments if cash gets short.<br />

Most importantly, document both the signals of problems and your solutions.  That way, if the signals happen again, you can refer to prior successful action as a first possible solution.<br />

Imagine possible, but normally unpredictable cash flow challenges.  Some problems can't be anticipated, so "what if" scenarios can be created.  You don't have to get elaborate, but you can ask what would happen if there were a flood, or, as we've experienced more recently, a devastating hurricane.  What then?  Other problems, such as "product sabotage" can only be dealt with as they occur. </P><P> Constructing possible scenarios to reduce risks associated with "unforeseeable" problems is an important management tool.  Learn from, and document, each experience, or you may have to repeat it.<br />

Second, watch sales.  Any prolonged (and "prolonged" computes differently for each company and industry) drop in sales without a comparable -- and simultaneously emerging --  reduction in expenses is a prescription for trouble.  Of course, there is at usually some lag between sales changes and a compensating contraction in expenses, but early diagnosis can reduce the negative impacts significantly.  Once a changing trend has been identified, act promptly or the impact of the lag will be more severe.<br />
<br />
Third, review the budget. </P><P> If short-term borrowing is regularly needed to meet normal operating costs, the unavailability of such loans or a sudden change in operating expense could be devastating.<br />
<br />
If ongoing operations cannot be supported by sales, either more sales are needed, fewer expenses must be incurred or a combination of the two is in order.  While this sounds very simple, all too many companies hesitate "in hopeful anticipation."  If remedies are not introduced on a timely basis, a severe cash crunch could follow.<br />

Fourth, keep a close eye on new product development.  In many companies, R&D expenditures for new products are often allowed far greater variance from projected budgets than normal expenditures.  After all, when you create something new, it is really hard to accurately predict costs -- or turnaround time -- at the outset.<br />

Failure to keep these costs, and time commitments, within bounds or monitor their continuing impact and cost/benefit can lead to continued funding of projects well beyond when they should be cut off.  Overall cash flow can be easily drained into a seemingly bottomless pit, and often an entire company is jeopardized by one errant project.<br />

Fifth, beware of pet projects. </P><P>  A pet project is any organizational activity undertaken for ego value rather than consistency with the organization's mission and profit targets.   Pet projects, whether new ventures or ongoing cost/profit centers, can often lead to cash flow problems.  All organizations have pet projects from time to time.  Failure to recognize and deal with a pet project when a cash crunch looms has been the death knell for many companies.<br />
<br />
Many cash flow challenges have such simple origins.  Often it's simply a matter of days, or weeks and they can creep up on you. </P><P>And the daily grind can cloud your vision, encourages false hope or distract you just long enough for problems to take hold.  You can learn from past and/or current cash shortages.  You can be watchful that sales, budget and R&D costs stay in line.  You can keep a lid on pet projects.  In an increasingly competitive world, you need to be alert.<br />
